Book chapter
Competence for Execution
Forensic Mental Health Assessment
01 Jul 2014
Abstract
The report in this chapter describes an evaluation of competence for execution. These evaluations have been guided by case law, although the statutorily defined criteria may differ by state. The principle illustrated by this case describes the importance of identifying relevant forensic issues as they apply to both the broad and the specific aspects of the legal question in a given case. The teaching point provides guidance on the identification of assessment targets when legal standards are broad or non-specific.
