Juvenile Transfer and Decertification

Abstract
The two reports in this chapter focus on the questions that can arise when juvenile offenders are charged in the adult criminal justice system. In many jurisdictions, juvenile defendants in criminal courts can attempt to have their cases decertified or transferred back to the juvenile justice system for disposition. Decisions regarding juvenile transfer have the potential to greatly affect the lives of those being evaluated, given the vastly different sentencing practices within the adult and juvenile justice systems, and usually incorporate FMHA regarding treatment needs and amenability to interventions in the context of public safety.
