Abstract
The two case reports in this chapter focus on the capacities of juvenile defendants to waive their Miranda rights. Juveniles especially may have difficulty providing knowing and intelligent waivers of rights, and as such, there are particular considerations related to juvenile Miranda waiver evaluations. The principle to be applied to the first case concerns the value of nomothetic data, derived from groups and applied to the individual in comparison with the larger group, to FMHA. The second case illustrates the importance of presenting and defending one’s opinions effectively, but without becoming adversarial.
