Book chapter
Personal Injury
Forensic Mental Health Assessment
01 Jul 2014
Abstract
The two reports in this chapter focus on FMHA in the context of personal injury, which is sometimes referred to as civil psychological injury. The principle associated with the first case in this chapter discusses the importance of considering whether to directly answer the legal question that is before the court. The teaching point for this case provides a more specific discussion on answering ultimate legal questions. The principle involved in the second case addresses the decision to decline a referral for personal injury evaluations when impartiality is unlikely, with a teaching point on situations in which the evaluator may find impartiality too difficult.
