Returned to Risk: Deportation of HIV-Positive Migrants

Abstract
This report describes cases in South Korea, Saudi Arabia, the United Arab Emirates, South Africa, and the US in which HIV-positive migrants were deported, and describes the need to develop policies guaranteeing uninterrupted treatment for this population. The principle of non-refoulement, has long been established in international human rights and refugee law, creating an absolute prohibition on the deportation of a person to another state where there are substantial grounds for believing that the person would be in danger of being subjected to torture or other cruel, inhuman, or degrading treatment or punishment.
