The purpose of this study was to investigate the contentious ground that resulted from the enactment of the Children's Television Act (CTA). The researcher intended to bring to the surface issues pertaining to the First Amendment and children's media policy implementation, the value and preservation of educational programming and lastly, the impact of the digital environment and, more specifically, online privacy on the CTA's future. Key historical events were analyzed to unearth the primary gaps and issues that are overlooked today with the breadth of children's content available on online platforms. The data that answered the research questions were collected through in-depth interviews with experts and professionals in children's media and policy advocacy. This study's findings showed that freedom of speech has little value when media entities are mandated to care for children's education and entertainment. Whether children interact with commercial or non-commercial entities, all media entities must embrace stronger regulations instead of explicitly adhering to the idea of a free marketplace. Secondly, educational programming should be available to all families on online and offline media platforms. Moreover, a review board should lead a national conversation for more research into the best qualities of an educational program and the solidification of media literacy in schools. Finally, the participants noted that online privacy has gained greater significance compared to the CTA, but such challenges do not dilute its importance. The CTA should set the example for protecting children from manipulative practices on the digital landscape and creating more educational programming on various new platforms. Broadcasters should also be better advised on the appropriate educational standards that their programming should carry.
