Abstract
The purpose of this thesis is to attempt to answer the difficult question when is public art that is privately owned considered public domain? This thesis will focus on a prominent current case that is struggling with this very issue - The Estate of John W. Merriam v. Philadelphia Historical Commission. This case, Merriam v. Philadelphia Historical Commission is about whether the City of Philadelphia, in an effort to preserve art and its cultural history uphold its public trust powers in its effect to stop a private concern from exercising its right of commerce regarding a piece of artwork which the City of Philadelphia feels should not be moved.
