Abstract
[...]the prosecutor had made a list of "Definite NOs," on which the first five names were the five African American prospective jurors. The United States Supreme Court granted certiorari in May 2015.\n Petitioner argues that the state habeas court's decision is not entitled to this deference because it relied upon rulings of the trial court and Georgia Supreme Court, which did not consider the prosecution's venire lists and notes. Because the state habeas court deferred to decisions that were based on "a fraction of the evidence that was ultimately presented," it did not give consideration to all relevant circumstances, as required by Batson.
