Abstract
The Individuals with Disabilities Education Act (IDEA) requires school districts to offer a free appropriate public education to children with disabilities. In Schaffer v. Weast 04-698, the Fourth Circuit ruled that the general evidentiary rule that places the burden of proof on the party who is initiating the proceeding and seeking relief should apply to the IDEA administrative hearings.
