Mediation: sanity in the regulatory process

Abstract
Procedural reform is needed in the way that public service commissions manage their responsibilities. The judicial-style adversarial methods in current use have created a self-perpetuating cycle of conflict. Mediation offers many advantages by dispensing with the legal maneuvering common to the adversarial setting and focusing on resolving the issues of importance. Territorial, rate and transmission disputes are all potential situations where mediation would prove beneficial.
