Title IX: beyond equal protection

Abstract
Explores the relationship between Title IX's statutory prohibition of sex discrimination in federally funded education programs and the Equal Protection Clause's prohibition of state action that amounts to harmful sex discrimination to argue that Title IX offers more protection. Discussion is centered on the text and history of Title IX, a comparison of Title IX and Equal Protection Clause jurisprudence, and the theoretical basis of both. In light of this analysis, pertinent court decisions are examined along with legal issues impacted by the analysis of the Title IX-Equal Protection Clause relationship.
